1. Purpose and Commitment
A.R. Bhatt Educational Institute (ARBEI) is committed to providing a safe, secure, and inclusive environment for all students, faculty members, and staff. In compliance with The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 — commonly known as the POSH Act, 2013 — the Institute upholds a zero-tolerance policy towards sexual harassment and any behavior that violates personal dignity or professional ethics.
2. Objective
This policy aims to:
- Prevent incidents of sexual harassment within the Institute.
- Provide a structured and confidential mechanism for reporting and redressal.
- Promote awareness and sensitivity among all stakeholders.
- Ensure that every woman — student, staff, faculty, or visitor — feels safe, respected, and empowered on campus.
3. Definition of Sexual Harassment
As per Section 2(n) of the POSH Act, sexual harassment includes any one or more of the following unwelcome acts or behavior (whether directly or by implication):
- Physical contact and advances.
- Demand or request for sexual favors.
- Making sexually colored remarks.
- Showing pornography.
- Any other unwelcome physical, verbal, or non-verbal conduct of a sexual nature.
Sexual harassment also includes conduct that creates an intimidating, hostile, or offensive work or academic environment, or interferes with an individual’s performance.
4. Applicability
This policy applies to:
- All teaching and non-teaching staff, students, research scholars, and interns.
- Visitors, vendors, and external individuals interacting within the campus.
- All workplaces under the Institute, including classrooms, offices, libraries, buses, laboratories, hostels, and any off-campus activity or event organized by the Institute.
5. Internal Complaints Committee (ICC)
In compliance with Section 4 of the POSH Act, ARBEI has constituted an Internal Complaints Committee (ICC) to prevent, prohibit, and redress any act of sexual harassment.
Composition of ICC:
- 1. Presiding Officer: A senior woman faculty member.
- 2. Two Faculty/Staff Members: Committed to gender equality and social justice.
- 3. One External Member: From an NGO or association familiar with issues of sexual harassment.
- 4. Student Representatives: (as applicable for student-related cases).
The ICC is responsible for:
- Receiving written complaints of sexual harassment.
- Conducting inquiries in a fair, confidential, and time-bound manner.
- Recommending appropriate disciplinary or corrective action to the Principal/Management.
- Submitting annual reports to the management and relevant authorities as required by law.
6. Procedure for Filing a Complaint
- 1. A written complaint should be submitted to the ICC within three months of the incident.
- 2. The ICC will acknowledge the complaint and conduct an initial review.
- 3. Both the complainant and respondent will be given equal opportunity to present their cases.
- 4. The ICC will complete its inquiry within 90 days and submit recommendations to the management.
- 5. Appropriate action will be taken within 60 days based on the findings.
- 6. Confidentiality will be strictly maintained throughout the process.
7. Awareness & Training
The Institute shall:
Conduct regular workshops, seminars, and awareness sessions on gender sensitization and the prevention of sexual harassment.
Display this policy and contact details of the ICC prominently on notice boards and the official website.
Encourage open dialogue and continuous education to maintain a respectful campus culture.
8. False or Malicious Complaints
While genuine complaints are protected under this policy, false or malicious allegations will be subject to disciplinary action as per the provisions of the POSH Act, 2013.
9. Confidentiality
All proceedings, recommendations, and actions under this policy shall remain strictly confidential, and disclosure of any information is prohibited except when required by law.
